Terms and conditions

These terms and conditions apply to you if you choose to work with Eaves Editorial on your manuscript. Paying your 25% deposit will confirm that you have read and understood these terms, and that you agree to them, so please read them over carefully.

Overview

  • These terms and conditions apply to work done by Eaves Editorial/Rachel Rowlands for the editorial client (you).
  • You are under no obligation to offer Eaves Editorial work. Eaves Editorial has no obligation to accept work from you.
  • Services will be provided as agreed upon in writing.
  • Eaves Editorial will carry out unsupervised editorial work at a time and location of their own choosing, using their own equipment.
  • The editorial client is responsible for checking for updates to these terms before booking new services.
  • Eaves Editorial/Rachel Rowlands operates as a self-employed sole trader. She is responsible for her own income tax and national insurance contributions and won’t claim benefits offered to the client’s employees.
  • Eaves Editorial is not VAT registered.
  • The editorial client must be over eighteen.
  • Payment of a 25% deposit confirms you have read these terms and conditions, understood them, and agreed to them.

AI policy

  • Eaves Editorial supports human expression, providing editorial services for human-written works. Eaves Editorial does not provide editorial services for works where the text has exclusively been created or generated by AI or a language learning model.
  • The use of assistive AI tools (for research organisation, structural organisation, and so on) is accepted. If assistive AI tools have been used during the planning and self-revision stages, please disclose this to Eaves Editorial prior to booking a service.
  • The editorial client agrees not to feed Eaves Editorial’s notes, edits, feedback or emails into any form of AI or language learning model.
  • Eaves Editorial does not use AI during any stage of the editing process. All edits, queries, notes and commentary are created by Rachel at Eaves Editorial.
  • Eaves Editorial will not upload or feed any client writing into any AI software or language learning model.
  • No content on this website must be fed into any AI software or language learning model.

Editorial services

  • Files must be sent twenty-four hours prior to the agreed start date.
  • If files are not received on time, Eaves Editorial may cancel or reschedule the edit.
  • Eaves Editorial adheres to the codes of practice of the editorial organisations they belong to, including working to provide high-quality, industry-standard editing. However, editing cannot be 100% perfect, and a small number of residual errors may remain. The editorial client accepts and acknowledges this.
  • Eaves Editorial may use projects in their editorial portfolio, unless the editorial client chooses otherwise.
  • The editorial client will seek permission from Eaves Editorial to publish their name in final copies of the book or acknowledgements sections.
  • Should the editorial client wish to cancel, they should provide four weeks’ written notice by email. This must be acknowledged by Eaves Editorial. The service will then be cancelled and the editorial slot released.
  • If less than four weeks’ notice of cancellation is given, Eaves Editorial reserves the right to charge 100% of the fee (less the deposit).
  • If the editorial client cancels while editorial work is in progress, Eaves Editorial reserves the right to charge 100% of the fee (less the deposit).
  • Should the editorial client wish to reschedule, four weeks’ notice should be given. If four weeks’ notice is not given, Eaves Editorial will charge a rescheduling fee equal to 25% of the total quote.
  • The editorial client will respond to Eaves Editorial in a timely fashion during an edit. If the editorial client is unresponsive for over 10 days, Eaves Editorial may pause or cancel the edit. The editorial client must pay for any work completed.
  • Eaves Editorial may cancel work or reschedule in the case of circumstances such as severe illness or a bereavement. In such cases, Eaves Editorial will inform the editorial client to suggest new time frames or to find the client a suitable replacement editor. The client will only be charged for any work completed. Deposits remain non-refundable but may be applied as credit towards a new service within 12 months.

Payments

  • The fee for the edit will be agreed upon and confirmed in writing.
  • A 25% deposit is required to book an editorial slot with Eaves Editorial. This deposit is non-refundable. Deposits are payable within three days of invoicing. The editorial slot will not be confirmed until the invoice is paid.
  • The deposit will be taken off the editorial client’s final invoice.
  • The final payment for the edit will be due when the edit is complete and will be payable within three days.
  • If Eaves Editorial discovers that significantly more work is required during the early stages of the project, Eaves Editorial may renegotiate the quote or cancel the project.
  • For long or more complex projects, payments may be taken periodically. This will be agreed and confirmed upon in writing.
  • Eaves Editorial reserves the right to charge interest and compensation under the Late Payment of Commercial Debts (Interest) Act 1998, should the editorial client fail to pay an invoice on time.

Confidentiality and copyright policy

  • The editorial client’s work and its contents remain the property of the client, and it will be kept confidential and not made known to outside parties.
  • The editorial client agrees that any written editorial reports, in-line annotations and comments, and written communications from the editor by email are protected by copyright and are the intellectual property of Eaves Editorial. These editorial reports, annotations, comments, and emails should never be integrated into the client’s own documents, and should not be shared or published publicly, including on social media platforms, websites, or blogs, without written permission. For the sake of avoiding doubt, this does not apply to direct edits to the text using the Track Changes feature or Adobe’s PDF editor, and it does not apply to alternative phrasing and rewording options suggested by the Editor (whether written in a comment box or otherwise).

Data protection

  • The information that the editorial client and Eaves Editorial retain on record falls under the General Data Protection Regulation (GDPR). No more such information will be held than is necessary, at any time, to comply with those terms and with any compliance statement or privacy policy published by the editorial client and/or Eaves Editorial.
  • Both the editorial client and Eaves Editorial agree that, where consent is required to hold or process such data, such consent has been requested and obtained and both facts can be demonstrated. Either may view the other’s records to ensure that they are relevant, correct and up to date.
  • Should the editor at Eaves Editorial become unwell or incapacitated, and where the editor at Eaves Editorial is unable to make contact with the editorial client themselves, the editorial client’s details (name and email) may be given to another individual to contact the client on their behalf to inform them of any disruption to the service. The editorial client acknowledges and agrees to this.

Legal jurisdiction

  • This agreement is subject to the laws of England and Wales. Both Eaves Editorial/Rachel Rowlands and the editorial client agree to submit to the jurisdiction of the English and Welsh courts.
